LEGISLATIVE DECREE 196/2003: in compliance with the Italian Legislative Decree Article 196 no. 13 dated 2003 your personal details are used and processed for a proper management of obligatory statutory and tax fulfilments. 

General requirements These conditions govern the sale exclusively between the company PAKA CANADA INC. 1401 Legendre West, suite 305, in Montreal, Quebec, H4N 2R9, NC. 1450872-6 NEQ 1178155983 and the natural or legal person, hereinafter "the Customer", proceeding to the purchase of products made on the website www.pakaoliveoil.com. These terms and conditions may be subject to change, the date of posting is equivalent to the date of entry into effect.

These general conditions regulate the purchases made on the website www.pakaoliveoil.com in accordance with article 50 and following D.lgs 206 of September 6, 2005, Consumer Code, section II of chapter I of the third title of the third Party, which should be consulted as required by art. 60 of the Consumer Code.

ARTICLE 1 – Object of the contract

With these general conditions of sale, the company PAKA CANADA INC. sells online and the CUSTOMER purchases products remotely, represented and sold on the website www.pakaoliveoil.com.

The contract is concluded exclusively online via the Internet after the CUSTOMER has accessed www.pakaoliveoil.com, has confirmed and placed the order in accordance with the procedure provided for on the www.pakaoliveoil.com website.

ARTICLE 2 - Conclusion and effectiveness of the online contract

1. The sale is concluded when PAKA CANADA INC. sends the CLIENT an order confirmation email. The email provides a summary of the products selected by the  CUSTOMER including their prices, shipping expenses and the designated delivery address for the goods. The CUSTOMER is responsible  to verify the accuracy of their personal information contained therein and to promptly communicate any changes.

2. PAKA CANADA INC. commits to presenting and describing  the items available on the website as accurately and comprehensively as possible. Nevertheless, occasional errors, inaccuracies or minor discrepancies may occur between the website and the actual product. Furthermore, the product photos displayed on the website www.pakaoliveoil.com are intended for illustration purposes only and do not constitute a binding part of any contract.

3. PAKA CANADA INC. commits to delivering the goods within 7 days starting from the day following the date of order confirmation by the CLIENT.

ARTICLE 3 –  Availability of items

1. The availability of items pertains to the stock that is on hand at the moment when the CLIENT reviews the technical specifications of the products. However, it is important to note that product availability must be regarded as approximate. Because of the simultaneous presence of multiple users on the site, products may be sold to others prior to the order confirmation.

2. Even after PAKA CANADA INC. has sent an email confirmation of the order there may be instances of partial or total unavailability of the products. In such situations, the CUSTOMER will be promptly notified and can choose to either accept the delivery of the available items or request order cancellation by communicating with us by email at info@pakaoliveoil.com.

ARTICLE 4 – Payment methods 

1. The CUSTOMER can make payment on the website www.pakaoliveoil.com using a debit card, credit card or PayPal. For payments made by debit, credit or PayPal card, if an item becomes unavailable after the order is placed, and the amount has been withheld on your card, PAKA CANADA INC. will take all necessary steps with the payment operator to reverse the transaction associated with the unavailable items. . Please note that your order is only charged when your items are fully available and have been shipped. As a result, if an item is not available, and no replacement item can be delivered, your payment card will not be charged.

2. Communication pertaining to payment and details provided by the CLIENT during the payment process will occur over dedicated secure channels, with all the guarantees ensured by the use of security protocols as offered by the payment networks.

3. Freight charges do not include customs clearance fees which are the responsibility of the consignee and will be processed in the destination country by the designated carrier.

ARTICLE 5 – Prices 

1. All product sales prices listed on the www.pakaoliveoil.com website are in Canadian dollars, all taxes included (GST/QST).

2. The prices listed on the website do not include transport costs. However, these will be provided and calculated at the conclusion of the purchasing process before payment.

3. The CUSTOMER acknowledges PAKA CANADA INC. has the right to alter its prices at any time. Nevertheless, PAKA CANADA INC. commits to invoicing the goods ordered at the prevailing prices displayed on the website when the order is placed and confirmed via email by PAKA CANADA INC. as an order confirmation of the acquisition of the order.

ARTICLE 6 – Return and refund policy

1. In accordance with the prevailing legal regulations, the CUSTOMER has the right to withdraw from the purchase within 14 days of product delivery. This withdrawal can be made without incurring any penalties and without the need to specify any reason. 

2. If the CUSTOMER chooses to exercise this right, they should initiate the RETURN process by sending an email to info@pakaoliveoil.com. Products must be returned to PAKA CANADA INC. at the following address 9200, Meilleur street, Montreal, Quebec, Canada, H4N 2A9 . As per legal requirements, the transport expenses for returning the goods are the responsibility of the CLIENT. Products must be returned in their original packaging, complete with all their components, including packaging, all documentation, accessories and tax records attached. Without prejudice to the right to verify compliance with the aforementioned, PAKA CANADA INC. will promptly refund the amount for the withdrawn products with a maximum processing period of 30 days. The delivery of the goods and the costs of bank transactions will be borne by the CLIENT.

3. In the event of receiving an item, that does not conform to your order or has been damaged during transport, as per art. 132 of the Consumer Code, the CLIENT must report this by email to info@pakaoliveoil.com within 60 days from the date of delivery. Subsequently, the CUSTOMER must return the product, indicating whether they prefer a replacement or refund. PAKA CANADA INC. will coordinate with the carrier who will arrange for the collection of goods, subject to availability. PAKA CANADA INC. reserves the right to verify the reported non-conformity, and upon confirmation, will issue a  replacement or refund by crediting the card used for the purchase.

4. The return of custom-made and/or personalized products is not provided for, except in the cases of clear non-conformity.

ARTICLE 7 – Product warranty

All products featured on the website www.pakaoliveoil.com are covered by a contractual warranty,  the duration of which  is specified in the product’s technical data sheets and in any case the legal warranty of 24 months for defects, in accordance with the current legislation. To claim the warranty, the customer must keep the invoice.

ARTICLE 8 – Details of delivery

1. PAKA CANADA INC. exclusively accepts orders from within Canada. The products will be delivered by courier to the address specified by the CLIENT during the order placement.

2. For every order placed on the site www.pakaoliveoil.com, PAKA CANADA INC. generates an invoice. The information provided by the customer during the purchase process is considered authentic for the purpose of creating the invoice. Once the invoice has been issued, no alterations to the provided data can be made.

ARTICLE 9 – Liability

1. PAKA CANADA INC. disclaims any liability for disruptions resulting from force majeure, unforeseeable causes or malfunctions of the Internet.

2. The availability of each item is provided for information purposes only and is not not considered a contractual agreement. Furthermore, the seller bears no liability in the event that one or more products becomes unavailable.

ARTICLE 10 –  Access to the Website

The CUSTOMER has the right to access the website for consultation and purchases. Any other form of use, particularly commercial purposes of the website or its content is strictly prohibited. The integrity of this website’s elements whether they are audio or visual, along with the underlying technology used remains the exclusive property of PAKA CANADA INC. and is protected by intellectual property rights.

ARTICLE 11 – Delivery to remote locations

Unfortunately our special rate cannot be applied to shipments heading to remote locations. The shipping cost will be calculated individually based on  the destination and will be communicated to the customer prior to order confirmation.
